AMENDMENTS to the Divorce Act, Canada effective March 1, 2021

The new changes to the Divorce Act in Canada take effect March 1, 2021. There are some important changes regarding parenting issues which will affect separating married couples with children. Speak with Katherine Kubica to understand these changes now.
The Courts prefer it if parents can resolve parenting matters amicably, however, some people have to fight for the right to be an equal parent to their children.

The Court is concerned with what parenting arrangement is in the children's best interest. In determining best interest, the Court looks at a number of factors, including:

the nature of the child’s relationship with each spouse, with siblings and with other important people in the child’s life;
each spouse’s willingness to encourage the child’s relationship with the other spouse;
the child’s views and preferences;
the child’s cultural and linguistic upbringing, including the child’s Indigenous heritage;
the ability of each spouse to care for the child;
the presence of any civil or criminal court actions and orders that are relevant to the wellbeing of the child; and
the presence of family violence.
